What the EU ruled about AI chatbots on WhatsApp in 2026, and what it means for you

You used to text ChatGPT on WhatsApp like any other contact. Then in January the number went quiet, Copilot sent a goodbye message, and a few months later your friend in Berlin said ChatGPT was working again for her. It's been a messy year of regulators, fees and appeals.
On January 15 2026 Meta started blocking general-purpose AI chatbots like ChatGPT, Copilot and Perplexity from the WhatsApp Business API, leaving Meta AI as the only one. On June 9 2026 the European Commission ordered Meta to give those chatbots free access again across the European Economic Area (Italy already had its own order) while it investigates, and Brazil, Italy and Türkiye forced similar exceptions. Outside those places the ban still applies. None of this touches assistants that run on your own number as a linked device, like Perisclaw.
What did Meta change in January 2026?
On October 15 2025 Meta added a clause to its WhatsApp Business terms barring "AI Providers" whose main product is the AI itself, meaning large language models and general-purpose assistants. Support and order-tracking bots weren't affected. The rule took effect on January 15 2026, and that day ChatGPT, Microsoft Copilot and Perplexity went dark on WhatsApp. Meta's terms still say this today, with exceptions only for the countries where regulators made it allow them.
What exactly did the European Commission order?
The Commission opened an antitrust investigation in December 2025. In March 2026 Meta let rival assistants back in, but for a per-message fee, which the Commission found was "in practice equivalent to the previous access ban".
On June 9 2026 it issued interim measures, a power it has rarely used. The order said Meta must:
Restore access: let third-party general-purpose AI assistants use the WhatsApp for Business API on the terms in place before October 15 2025, which were free.
Keep it that way: maintain that access until the Commission makes a final decision on the case.
Move fast: comply within five working days, or face fines of up to 10% of annual turnover and daily penalties.
It is not a final ruling that Meta broke the law; the full investigation (case AT.41034) is still open. Meta called the order "regulatory overreach" and appealed to the EU General Court in August 2026. Among the complainants was The Interaction Company, the startup that makes Poke.
What happened in Brazil, Italy and Türkiye?
Brazil: the competition authority CADE ordered Meta to suspend the policy in January 2026, and Meta exempted +55 numbers from day one. From March 11 Meta charged AI providers $0.0625 per message there. In April CADE ruled that the fee broke its order and kept a daily fine of BRL 250,000, but a São Paulo federal court suspended that fine on April 29. Meta's AI Providers page still lists Brazil as a charged market.
Italy: the competition authority AGCM ordered a suspension in December 2025, so Italian numbers were exempt before the rest of Europe.
Türkiye: on June 5 2026 the Competition Authority announced an investigation and interim measures it had decided on May 14. Meta added Türkiye (+90) to its allowed list, without charges, from October 15 2026.
Which AI chatbots work on WhatsApp now?
As of November 2026, it depends on your phone number's country code, not where you are standing.
Chatbot | Status |
|---|---|
ChatGPT (1-800-ChatGPT) | Back since July 13 2026 for EEA numbers only |
Microsoft Copilot | Left on January 15 2026; Microsoft pointed users to its own apps |
Perplexity | Went dark on January 15 2026 |
Luzia, Zapia | Kept working for Brazilian numbers |
Poke | On Apple Messages and Telegram; WhatsApp only in some countries |
Meta AI | Built in everywhere it's offered |
If you're in India, the US, the UK or most of Latin America outside Brazil, the general-purpose bots are still blocked on WhatsApp. The apps still work; only the WhatsApp contact is gone.
Bots on Meta's business platform vs an assistant on your own number
Every chatbot in that table is a business account you message. It lives on Meta's WhatsApp Business Platform, so Meta's terms decide whether it can exist in your country and what it costs the provider. It also only sees what you send it.
Perisclaw works differently. It connects to your own WhatsApp number as a linked device, the same way WhatsApp Web does, and works on a regular WhatsApp or WhatsApp Business app number. It doesn't use the Business API, so the AI Providers rule doesn't apply to it. You talk to it in your self-chat or by typing /claw in any chat, it reads the chats you allow, catches up busy groups, tracks what you promised people, and drafts replies that it sends after you approve. You can also connect it to ChatGPT or Claude and ask either one about your own chats.
One honest caveat: linked devices weren't built for outside tools, and WhatsApp's help centre warns that unofficial apps can lead to a ban. Perisclaw is built for normal personal use and stops after 15 chats before anything looks like bulk sending.

FAQ
Did the EU ban AI chatbots on WhatsApp?
No, the opposite. Meta blocked rival chatbots; the European Commission ordered Meta to let them back in for free across the EEA (Italy was already covered by its own order) while it investigates.
Is the EU decision final?
No. It's an interim measure that lasts until the Commission's final decision, and Meta has appealed it to the General Court.
Can I use ChatGPT on WhatsApp in India or the US?
Not through 1-800-ChatGPT; it only answers EEA numbers. You can use the ChatGPT app, or connect your WhatsApp to ChatGPT through Perisclaw's ChatGPT plugin.
Why does Meta AI still work everywhere?
Meta AI is Meta's own assistant, and the rule only covers outside AI providers. That gap, Meta's assistant in and rivals out, is what regulators objected to.
